1. Acceptance of Terms

By accessing or using the services of Horizon Peak Active Wellness ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Health & Safety

Our programs are designed for active older adults. You acknowledge that:

• You should consult a physician before beginning any new fitness program.
• You are responsible for disclosing any health conditions that may affect your participation.
• You agree to follow trainer instructions and stop any activity that causes pain or discomfort.
• We reserve the right to request a medical clearance before you participate in certain programs.

3. Memberships & Packages

All package sessions are prepaid and must be used within the timeframe specified at purchase, or within 12 months if no timeframe is specified. Sessions are non-transferable unless agreed in writing. We reserve the right to modify pricing with reasonable notice.

4. Cancellations & Refunds

Individual session cancellations require at least 24 hours' notice. Late cancellations may be charged as a attended session. Refunds for unused packages are available within 14 days of purchase, less any sessions already completed. Please see our Payment Policy for full details.

5. Liability Waiver

Participation in physical fitness activities involves inherent risks. To the fullest extent permitted by law, Horizon Peak Active Wellness and its trainers are not liable for any injury, loss, or damage arising from your use of our services, except where caused by our gross negligence or willful misconduct.

6. Intellectual Property

All content on our website and materials provided during sessions, including exercises, programs, and written guides, are the property of Horizon Peak Active Wellness and may not be reproduced or distributed without our written consent.

7. Changes to Terms

We may update these Terms of Service from time to time. Material changes will be communicated via email or posted on our website. Continued use of our services after changes constitutes acceptance of the updated terms.
